Liberia is witnessing intriguing developments, particularly in the aftermath of a recent elections, inauguration and presidential address to the nation.
During the address to the nation, President Boakai focused on the concerns of the wives of soldiers in the Armed Forces of Liberia (AFL).
In that address, several key points were emphasized, including the establishment of a committee to investigate concerns of AFL wives. And notably, President Boakai expressed dissatisfaction with the manner and process of presidential pardons, to which he activated the board of inquiry of the AFL. specifically relating the issues affecting the soldiers.
Although no names were mentioned, it is evident that his remarks were directed at the former President, George Weah who recently pardon former Defense Minister, Brownie Samukai.
Samukai recent pardoned by former President George Weah, seems to be the speculation that President Boakai disapproves of. Meaning the way this pardon among others were granted.
If that is true, the central question now arises: Can a sitting President revoke a constitutional pardon issued by their predecessor? In this case, George Weah who pardoned the Former Defense Minister Brownie Samukai and others?
To answer this central question, when the constitutional provision as outlined in Article 59 of the Liberian constitution was applied to pardon, remains critical and a burden on the office of the president to say whether or not he has the authority to do so.
However, as the board of inquiry is activated, tasked with investigating this matter, and expected to report findings within two weeks. observers await to see democracy and the balance of power play-in whether recommendation to revoke the presidential pardon or if constitutional advisors will intervene otherwise, remains a guess.
As to the matter, it can be recalled that On January 27, 2022, Samukai, along with associates, was convicted and ordered imprisoned for embezzlement. The Supreme Court of Liberia sentenced him to two years in prison for failing to return stolen funds from the Armed Forces of Liberia pension account for funds that were misappropriated during the mandate of former President Ellen Johnson-Sirleaf when Samukai headed the defense ministry.
